New Attorney: No Casey Anthony Trial By October The newest member of Casey Anthony's defense team said there is no way Anthony's trial will start in October. Andrea Lyon, a professor at DePaul University College of Law, was introduced at a hearing Thursday. Lyon is to handle death-penalty matters. She said because she is just learning the case, she will need more time to prepare a defense. Lyon also said she will prove the case does not qualify for the death penalty. See said motions will be filed in the next few months showing that the state does not have sufficient evidence to prove that Anthony's case is a death penalty case. Thursday morning's hearing on the release of a jail video of Anthony ended without a decision. Prosecutors argued that they have not had enough time to review and response to the new motion. Circuit Court Judge Stan Strickland also wanted to give attorneys for media outlets seven days to argue for the release under the state's public records law. Anthony’s attorney filed the motion late Wednesday laying out arguments for why the jail video of Anthony should be sealed. The 17-page motion makes several arguments against the video’s release, including that it was cruel, that it violated her right to counsel, and that it invades her right to keep medical records private. Strickland also heard arguments from several people who have objected to the defense's request for their phone records, including Roy Kronk, the former meter reader who found Caylee's remains. The judge is requiring Baez to amend the motion to limit the amount of information he is seeking. The jail video was made on the day a child’s body was found in December 2008. The child was identified later as Anthony’s daughter, Caylee. In his motion, attorney Jose Baez argues that the videotaping was orchestrated to “get some reaction to the discovery of Casey Anthony’s remains believing that it was evidential in some way.” Anthony is Orange County Jail awaiting trial on a first-degree murder charge in connection with Caylee’s death. According to those who've seen the jail video, Casey Anthony is watching breaking news coverage of the discovery of a small child's remains near her home. She reportedly doubles over, then later, according to witnesses, asked for a sedative. Baez said the video also captured part of his meeting with Casey Anthony in jail that same day. Although there is no sound on the video, Baez claims it is a violation of Casey's right to attorney-client privilege. Also Thursday, Baez will argue why he should be entitled to subpoena a sweeping amount of information from a number of key players in the case; much of it revolves around telephone records. Just this week, one of the people subpoenaed, Casey's former fiancée, Jesse Grund, filed an objection in court saying Baez' subpoena is too broad and would constitute an invasion of privacy. Others, including Casey Anthony's friend Amy Huizenga and the man who discovered Caylee's remains, Roy Kronk, have filed similar objections. Baez also said he plans to introduce Anthony's new death-penalty-qualified lawyer on Thursday at the hearing before Judge Stan Strickland.

Casey Anthony’s New Lawyer Talks About The Case A defense team has been put in place for the trial of Casey Anthony, who is facing charges that she murdered her daughter, Caylee Anthony. Last night, Anthony’s newest attorney, Todd Macaluso, spoke with WKMG. Some interesting stuff in the interview. From the article: Eight attorneys will strategize over the next few months to defend Casey Anthony, and at least one of them — Todd Macaluso — is already openly saying the defendant is innocent. “She should not be in jail right now,” said Macaluso, who met Casey Anthony for the first time Monday.Macaluso is a high-powered California attorney who handles a lot of civil case litigation.He’s previously represented professional baseball players and the families of Marines. According to his biography, he’s settled cases for a total of about $200 million for his clients and he said he has a 92 percent win rate in jury cases. Now Macaluso will bring his talents to the eight-lawyer defense team for Casey Anthony. “The more people and the more talent and different experience that we have on the case will certainly contribute to the best case being put on,” Macaluso said. “I think everyone adds a different dimension to a very good trial team. “This is a combination that Macaluso thinks will be successful. “I’m confident that we can win this case,” Macaluso said, who said he wouldn’t have joined the team if he didn’t think they could win. Part of Macaluso’s confidence is based on his opinion of the state’s case against Casey Anthony. “Putting aside the quote ‘junk science,’ the prosecution has no evidence in this case,” Macaluso said. The “junk science” that Macaluso mentioned refers to the forensic tests that have been done in this case, including those on hair in Anthony’s car and alleged evidence of decomposition. “We just want you to wait until the evidence is presented at trial. There’s an explanation for everything,” said Macaluso, whose expertise is in the technical aspects of a trial and in cross-examining witnesses. One area where the defense knows it’s not winning is the battle of public opinion. Macaluso urged people to wait until the trial before making a judgment. “The evidence is going to be very surprising to a lot of people in this community,” Macaluso said. While representing Casey Anthony could be considered a career risk for Macaluso, the attorney isn’t concerned. “If I thought she was guilty, I wouldn’t be sitting here right now. Who did she say she handed the child to? Was it Zanny? Was it Tony? Was it Ricardo? Was it Jesse? Was it Amy? With so many possible scenarios how could any thinking person like Mr Macaluso say with certainty that Casey Anthony is innocent? We know that a majority of defendants who sit at the defense table are guilty. They were not rounded up on the street corner to face charges relating to Felony Murder. I with all of my heart can not believe that she maliciously killed her toddler, which would have to be the case for 1st degree. Maybe a lesser charge…which could be “time served” because she would have been in jail for over a year at the time of trial’s end. I am very interested to know just what happened to this sweet, sweet baby girl. I know Casey has a part, but not first degree. March 5, 2009 at 9:54 pmIt is looking like the defense team are various pros at smoke and mirror techniques much like the O.J. Simpson case. The circumstantial evidence does not stand on the evidence found in the car but one the total package. This is not a Perry Mason show where the defense can hide their information from the DA’s office. There must be full disclosure on both sides of what they are presenting so that cross examination is done thoughtfully and deliberately. While we might not want to believe in our hearts that this lying, stealing, single mom, man chasing, manipulative drama queen party girl did not kill Caylee to free up her life, it is reasonable that she very well may have. BTW, as high as we place moms on a pedestal, the reality is that percentage wise more single moms murder their children every year than single dads do. March 6, 2009 at 12:12 amHere Here! Oh, and he “openly stated” that “the Defendant is Innocent”!!?? What the hell ELSE would you EXPECT a Defense Attorney to say! What we have here is the Defense’s realization, as in a Combat Zone, that they’ve got 7 men down and need backup. It’s no secret, no matter what, NO WAY they can get out of being “married” to Casey’s own incriminating story, all along, that Ms. Gonzales from Sawgrass Apartments took her Daughter. This is what they have, they’re stuck with it now, and we all know THIS can not be changed, or denied, simply by the addition of a different player in the game. And it would give her some trash to lay around Caylee body in that lot so Caylee would blend into the area.

I found this to be pretty interesting how we have many others that agree with us....and know that Casey Anthony is Guilty of killing Caylee...... Casey Anthony: New attorney says state has no grounds to seek death Attorney Andrea Lyon explained her approach to defending Casey Anthony: blunt and bold. "She calls herself the Angel of Death Row," WESH-Channel 2's Amanda Ober said in profiling the new attorney on the Anthony defense team. "Lyon says the state has no grounds to seek the death penalty for Anthony, and Lyon plans to fight it," Ober said. Anthony is charged with the first-degree murder of her daughter, Caylee. "There is no question in my mind that they are seeking a tactical advantage," Lyon said of prosecutors. "And I intend to say so bluntly, boldly and in front of this court." Lyon also said: "I believe that the Florida law simply doesn't allow asking for the death penalty in these circumstances." "Hello she killed her Baby" Ober said Lyon is becoming the lead attorney on the case because Jose Baez is not qualified. Ober asked Lyon if she will lead the case. "She said, well, the law requires she be called the lead counsel," Ober added. "She sees herself as an equal member of the team." WESH's Bob Kealing noted that Baez "bragged in court" that Lyon had never lost a death-penalty case. In other developments, attorneys for three witnesses fought Baez's request for their clients' cell phone records. Judge Stan Strickland said Baez needed to be more specific about what he wants from the three witnesses, Kealing reported. Kealing also kept tabs on the Anthonys: Cindy Anthony, mother of Casey, got emotional several times, but Casey Anthony was "all business" and wrote several notes to her lawyers. WFTV-Channel 9 focused on Baez's flawed efforts today. Anchor Bob Opsahl said Baez "tried to accomplish three things, but he didn't file the proper paper work for any of them. ... And that means everyone will have to go back to court to hear the same motions all over again." Anchor Martie Salt explained those three things: introducing Lyon, seeking phone records from witnesses and blocking the release of a jail videotape of Anthony. WFTV's Kathi Belich said Baez filed incomplete motions and failed to give legal reasons for seeking the phone records. Lyon hadn't filed her documents to be accepted by the court, Belich added. Yet WESH's Kealing said Baez "got a big chunk of what he wants, specifically cell-phone records from a number of key witnesses." Kealing added that the defense team "was shut down for now" on blocking the release of the jail videotape. WFTV's Salt said that Baez might have revealed his defense strategy by pointing to Jesse Grund, Anthony's former fiance, as a suspect. "Baez is going to try to say there were other suspects in this case," Salt said. "The sheriff's office never named Grund as a suspect in Caylee's disappearance or murder."
